All clients, partners, licensees, resellers, and white-label operators using domain-related services provided through Xdemór infrastructure, including services offered under the Fludnox brand.
0. Legal Status and Scope #
This Domain Name Policy (“Policy”) governs the use, registration (where applicable), administration, configuration, management, transfer coordination, suspension, and termination of domain-related services provided by The Xdemór Group Limited (“Xdemór”) in connection with its Services.
Domain-related services may include, depending on the applicable service model:
(a) client-owned domains delegated to Xdemór for technical administration or infrastructure integration;
(b) domains registered or administered through accounts operated by Xdemór for managed service delivery;
(c) domains temporarily acquired, reserved, or held by Xdemór for deployment, migration, launch protection, or other service-related operational purposes.
Xdemór acts as the Client’s contractual service provider for the managed service layer only.
Nothing in this Policy displaces, overrides, or replaces the independent rights, obligations, or enforcement powers of any applicable domain registrar, registry operator, ICANN, dispute resolution authority, or competent legal authority.
Where domain registration services involve third-party registrars or registries, such third-party terms, policies, operational rules, and enforcement procedures shall continue to apply independently.
This Policy applies prospectively and forms part of the contractual framework governing the Services, together with the Terms of Service and any applicable Individual Agreement.
1. Domain Registration Rights and Registrant Status #
1.1 Registrant Status #
Domain names are not infrastructure services in themselves and are subject to the rules of the applicable registrar, registry operator, ICANN, dispute resolution authority, and applicable law.
For the purposes of Xdemór’s Services, the registrant status and primary registration rights in a domain name are determined by the official registrar and registry records, as they may be updated from time to time.
Accordingly:
(a) where the Client is listed as the registrant in the applicable registrar or registry records, the Client is treated as the registrant for that domain;
(b) where Xdemór is listed as the registrant in the applicable registrar or registry records, Xdemór is treated as the registrant for that domain;
(c) where a domain is registered, held, or administered through an account operated by Xdemór, account-level administration by Xdemór does not, by itself, determine registrant status;
(d) payment of service fees, hosting fees, management fees, domain handling fees, or infrastructure fees does not transfer registrant status, ownership rights, transfer rights, or any proprietary interest in a domain name unless expressly agreed in writing and reflected through the applicable registrar process.
1.2 No Implied Assignment or Transfer #
Management, configuration, DNS control, hosting, routing, renewal assistance, account administration, or operational handling of a domain by Xdemór:
(a) does not constitute an assignment, sale, transfer, escrow, trust arrangement, or change of registrant;
(b) does not create any fiduciary, custodial, trustee, or registrar relationship between Xdemór and the Client;
(c) does not transfer ownership of Xdemór’s infrastructure, DNS architecture, routing logic, security configuration, automation, operational standards, or service delivery methodology;
(d) does not restrict Xdemór’s right to suspend, restrict, terminate, or apply Final Lock to the managed service layer in accordance with the Terms of Service and applicable Policies.
For avoidance of doubt, suspension, termination, or Final Lock of managed services does not, by itself, change the official registrant status of a Client-owned domain. However, such measures may affect DNS management, hosting, email routing, SSL configuration, support, access credentials, dashboards, redirects, integrations, and any other service layers operated by Xdemór.
1.3 Domains Registered or Administered Through Xdemór Accounts #
Where a domain name is registered, held, renewed, or administered through an account operated by Xdemór, the Client acknowledges that:
(a) the domain remains subject to the applicable registrar agreement, registry rules, ICANN policies, dispute resolution procedures, and applicable law;
(b) Xdemór acts as the Client’s contractual and administrative interface for the managed service layer, but does not act as an ICANN-accredited registrar unless expressly stated;
(c) Xdemór may be required to collect, verify, update, retain, transmit, or relay domain registration information, including registrant, administrative, technical, billing, and WHOIS-related contact information;
(d) the Client is responsible for providing accurate, complete, current, and lawful domain registration information where the Client or its representative is listed as registrant, administrative contact, technical contact, billing contact, beneficial user, or authorised party;
(e) where the Client provides information relating to any third party, end client, employee, director, representative, or beneficial user, the Client confirms that it has authority to provide such information and has obtained any required notices, consents, or legal basis for its use in connection with domain registration services;
(f) Xdemór may transmit requests, updates, or verification information to the applicable registrar, registry, or authority, but cannot guarantee acceptance, approval, continuation, disclosure, correction, suppression, renewal, transfer, or reinstatement of any domain registration.
1.4 Registration Data, WHOIS, Privacy, and Disclosure #
Domain registration data, including registrant and contact information, WHOIS-related records, privacy settings, registry data, and disclosure requests, is governed by the applicable registrar, registry operator, ICANN requirements, privacy service terms, and applicable law.
Where domain names are registered or administered through accounts held by Xdemór:
(a) Xdemór may receive, validate, process, and relay requests concerning domain registration data;
(b) Xdemór may assist with administrative communication between the Client and the applicable registrar or registry;
(c) Xdemór does not independently determine, approve, deny, or override registrar, registry, ICANN, court, law enforcement, or dispute resolution decisions concerning disclosure, suppression, correction, suspension, transfer, cancellation, or publication of domain registration data;
(d) disclosure or non-disclosure of domain registration data may occur in accordance with registrar policies, registry rules, ICANN requirements, lawful requests, dispute procedures, or applicable legal obligations;
(e) privacy or proxy protection may not be available for all domains, TLDs, registries, jurisdictions, or registration models.
1.5 No Override of Registrar or Registry Authority #
Nothing in this Policy shall be interpreted as limiting or overriding the rights of any registrar, registry operator, ICANN, dispute resolution provider, court, regulator, law enforcement authority, or other competent authority to suspend, cancel, lock, redirect, transfer, disclose, restrict, refuse, or otherwise modify a domain name registration or related service.
Xdemór shall not be liable for any loss, interruption, suspension, non-renewal, cancellation, disclosure, failed transfer, failed update, registry lock, registrar lock, dispute action, or enforcement measure caused by or arising from registrar, registry, ICANN, legal, regulatory, payment, abuse, or third-party platform action.
2. Domain Registration and Administration Models #
Xdemór may operate domain-related services under one or more of the following models. The applicable model depends on the registrar records, the service order, the operational setup, and any Individual Agreement.
2.1 Client-Owned Domains (BYOD) #
Where the Client supplies, owns, controls, or brings an existing domain name for use with Xdemór’s Services:
(a) the Client remains responsible for the domain’s registrant status, registrar account, renewal, payment, transfer eligibility, registry compliance, dispute handling, and ongoing accuracy of registration data;
(b) the Client grants Xdemór limited administrative, DNS, technical, and operational access solely for the purpose of delivering the Services;
(c) Xdemór is not responsible for registrar disputes, failed renewals, expiry, redemption periods, registry deletion, registrar locks, transfer delays, third-party claims, or enforcement actions relating to the domain unless expressly caused by Xdemór’s own proven fault;
(d) Xdemór may suspend, restrict, or terminate the managed service layer connected to the domain in accordance with the Terms of Service and applicable Policies, but such action does not by itself change the official registrant status of the domain.
2.2 Xdemór-Administered Domains with Client Registrant Status #
Where a domain is registered, renewed, held, or administered through an account operated by Xdemór, but the Client or a Client-designated party is listed as the registrant in the applicable registrar or registry records:
(a) the Client or Client-designated party is treated as the registrant for that domain;
(b) Xdemór acts as the administrative and operational interface for the managed service layer;
(c) the Client remains responsible for the accuracy, lawfulness, and maintenance of all registrant, administrative, technical, billing, and WHOIS-related information provided for the domain;
(d) Xdemór may assist with registration, renewal, configuration, transfer coordination, DNS management, privacy settings, or support, but does not guarantee registrar acceptance, renewal, reinstatement, transfer approval, dispute outcome, or continued availability;
(e) account-level administration by Xdemór does not create ownership, escrow, trustee, fiduciary, or registrar obligations toward the Client beyond the applicable service scope.
2.3 Xdemór-Registered or Xdemór-Held Managed Domains #
Where Xdemór is listed as the registrant in the applicable registrar or registry records, or where a domain is acquired, reserved, or held by Xdemór for service delivery, launch, staging, migration, brand protection, white-label deployment, or infrastructure purposes:
(a) Xdemór remains the registrant and controlling party for that domain unless expressly agreed otherwise in writing and completed through the applicable registrar process;
(b) the Client receives only a limited, revocable, non-transferable right to use the domain for the duration and purpose of the applicable Services;
(c) no ownership, equity, registrant status, transfer right, renewal right, redemption right, or continuing use right is granted to the Client unless expressly agreed in writing;
(d) payment of setup fees, service fees, management fees, hosting fees, domain handling fees, or renewal-related charges does not transfer registrant status or ownership rights;
(e) upon expiry, suspension, termination, non-payment, Final Lock, or discontinuation of the relevant Services, Xdemór may disable, park, redirect, retain, retire, repurpose, renew, transfer, or discontinue the domain, subject to applicable registrar, registry, ICANN, legal, and contractual requirements.
2.4 Transitional or Temporary Domain Holding #
Where Xdemór acquires or holds a domain temporarily for deployment, migration, reservation, launch protection, testing, staging, client onboarding, or operational convenience:
(a) the domain shall be treated as Xdemór-held unless the applicable Individual Agreement expressly states that the domain is being acquired for transfer to the Client;
(b) any future transfer to the Client is subject to full payment, written agreement, registrar eligibility, expiry status, transfer lock periods, identity verification, registry rules, and compliance review;
(c) Xdemór is not required to transfer a transitional domain where the Client has not fully paid, has breached the Terms, has triggered suspension or Final Lock, has failed verification, or where transfer is restricted by registrar, registry, ICANN, legal, fraud-prevention, or dispute procedures;
(d) no expectation of permanent use, renewal, exclusivity, or transfer arises merely because the domain was used in connection with a Client project or service environment.
2.5 White-Label, Agency, Reseller, and End-Client Context #
Where a reseller, agency, white-label operator, partner, intermediary, or Client uses Xdemór’s Services to support its own customers, end users, sub-users, or commercial relationships:
(a) Xdemór has no contractual relationship with such end clients unless expressly agreed in writing;
(b) the intermediary remains solely responsible for all representations, disclosures, approvals, consents, billing arrangements, domain ownership claims, service promises, and legal notices made to its own clients or end users;
(c) no domain ownership, registrant status, transfer right, renewal right, or direct service entitlement arises in favour of any end client against Xdemór unless expressly agreed in writing by Xdemór;
(d) the intermediary must not represent itself as an ICANN-accredited registrar, registry operator, registrar-equivalent provider, or owner of Xdemór-controlled infrastructure unless legally authorised to do so;
(e) the intermediary is responsible for ensuring that any required disclosures relating to the registrar, registry, ICANN rules, domain registration data, privacy settings, WHOIS information, renewal obligations, and third-party terms are provided to its own clients or end users where applicable;
(f) any breach, abuse, non-payment, dispute, misrepresentation, or regulatory issue caused by the intermediary or its end clients may result in suspension, restriction, termination, or Final Lock of the relevant managed service layer.
2.6 Determination of Applicable Model #
Where there is uncertainty as to the applicable model, the following hierarchy shall apply:
(a) the official registrar and registry records shall determine registrant status;
(b) the Individual Agreement, Order Form, Proposal, or written service confirmation shall determine any agreed transfer or usage rights;
(c) Xdemór’s Terms of Service and Policies shall determine the managed service layer, infrastructure access, suspension rights, support obligations, and operational control;
(d) the applicable registrar, registry, ICANN, dispute resolution, and legal rules shall prevail over any inconsistent operational arrangement.
3. DNS, Configuration, and Operational Control #
3.1 DNS and Managed Configuration Control #
Unless otherwise agreed in writing, DNS zones, DNS records, nameserver configuration, routing logic, redirects, proxy layers, SSL/TLS configuration, security rules, firewall settings, caching behaviour, failover mechanisms, email routing records, verification records, and related operational settings used in connection with the Services may be configured, maintained, modified, or removed by Xdemór as part of the managed service layer.
Xdemór may use one or more third-party providers, registrars, DNS providers, hosting providers, CDN providers, email providers, security providers, automation systems, or infrastructure platforms to deliver such configuration.
The Client acknowledges that DNS configuration and operational routing may be dependent on external providers, registrar settings, registry rules, propagation delays, nameserver behaviour, DNSSEC status, SSL validation, email authentication, third-party verification requirements, platform restrictions, and security controls outside Xdemór’s direct control.
3.2 Proprietary Configuration and Service Layer #
Configuration standards, orchestration logic, deployment patterns, DNS architecture, routing logic, proxy rules, security rules, cache settings, failover arrangements, automation workflows, diagnostic processes, monitoring logic, and operational defaults developed, selected, arranged, or maintained by Xdemór form part of Xdemór’s managed service layer.
Such materials are not transferred to the Client and do not become Client property merely because they are applied to, connected with, or used in support of a Client domain, website, email service, platform, or project.
Xdemór is not required to disclose, export, document, replicate, teach, or hand over its internal configuration standards, automation logic, operational methodology, supplier setup, diagnostic reasoning, or infrastructure design except to the limited extent expressly required for agreed domain portability or service migration.
3.3 Client-Owned Domains and Nameserver Changes #
Where the Client owns or controls a domain, the Client may retain or regain registrar-level control in accordance with the applicable registrar, registry, ICANN, legal, and contractual requirements.
However, if the Client changes nameservers, DNS records, registrar settings, DNSSEC settings, SSL validation records, email routing records, verification records, or any other domain configuration without Xdemór’s written instruction or approval:
(a) Xdemór shall not be responsible for downtime, email failure, SSL failure, verification failure, broken redirects, loss of tracking, failed analytics, loss of deliverability, service disruption, security exposure, or loss of functionality arising from such change;
(b) Xdemór may suspend support, charge additional recovery fees, require advance payment, or refuse remediation where the issue falls outside the agreed service scope;
(c) any recovery, reconstruction, audit, or reconfiguration work shall be treated as additional billable work unless expressly included in the applicable service plan.
3.4 Domain Portability and Basic Technical Records #
Where a Client-owned domain is being migrated away from Xdemór-managed services, and all outstanding payment, access, identity, security, and handover requirements have been satisfied, Xdemór may provide reasonable basic technical information necessary for domain portability.
Such information may include, where applicable and available:
(a) registrar-level release steps or transfer coordination information;
(b) basic DNS records necessary to point the domain to a new provider;
(c) MX, SPF, DKIM, DMARC, TXT, CNAME, A, AAAA, or verification records required for basic continuity;
(d) confirmation of whether the domain uses Xdemór-managed nameservers, proxy services, redirects, SSL validation, or email routing.
For avoidance of doubt, domain portability does not include any right to receive Xdemór’s proprietary DNS architecture, managed routing model, proxy setup, failover logic, security rules, automation workflows, performance configuration, monitoring structure, internal documentation, supplier account structure, or equivalent managed configuration.
3.5 No Right to Replication or Equivalent Configuration #
The Client shall not, directly or indirectly:
(a) copy, reconstruct, reverse engineer, derive, reproduce, or imitate Xdemór’s DNS architecture, routing logic, proxy setup, deployment standards, operational defaults, security configuration, automation workflows, or managed service methodology;
(b) require Xdemór to disclose internal configurations beyond what is strictly necessary for agreed domain portability;
(c) claim entitlement to equivalent configuration, equivalent performance, equivalent routing, equivalent security, equivalent deliverability, or equivalent operational behaviour upon migration to another provider;
(d) use information obtained through Xdemór’s Services to recreate, bypass, substitute, or materially reduce reliance on Xdemór’s managed service layer in breach of the Terms of Service.
Nothing in this clause prevents the Client from independently procuring domain, hosting, DNS, email, CDN, security, or infrastructure services in the open market, provided such procurement does not rely on, derive from, replicate, or exploit Xdemór’s non-public configurations, operational framework, automation, or proprietary service methodology.
3.6 Emergency, Security, and Compliance Changes #
Xdemór may modify, restrict, suspend, replace, remove, or override DNS records, routing, redirects, proxy settings, SSL/TLS settings, email routing records, security rules, verification records, or related configuration without prior notice where Xdemór reasonably considers this necessary for:
(a) security protection;
(b) abuse prevention;
(c) spam, phishing, malware, botnet, impersonation, or fraud prevention;
(d) compliance with registrar, registry, ICANN, hosting, email, CDN, payment, legal, or regulatory requirements;
(e) protection of infrastructure stability, deliverability, reputation, uptime, or other clients;
(f) prevention of misconfiguration, unauthorised access, data exposure, or operational risk.
Such action shall not be treated as breach, service failure, or unlawful interference where taken in good faith for risk-control, compliance, or operational protection.
3.7 Third-Party DNS and Platform Limitations #
Xdemór does not guarantee that any DNS, routing, SSL, email, verification, proxy, CDN, or platform configuration will be accepted, propagated, retained, validated, or continuously supported by any third-party provider, registrar, registry, browser, certificate authority, email provider, advertising platform, analytics platform, hosting provider, or security provider.
Xdemór is not liable for delay, failure, suspension, rejection, degradation, or loss arising from DNS propagation, registrar lock, registry lock, third-party DNS failure, SSL authority rejection, email provider filtering, CDN restrictions, platform verification changes, upstream provider enforcement, or third-party policy changes.
4. Transfers, Exports, Migration, and Disclosure Requests #
4.1 General Transfer Conditions #
Any domain transfer, registrar account push, change of registrant, DNS handover, migration support, export assistance, or release of domain-related control is subject to:
(a) the official registrant status shown in the applicable registrar or registry records;
(b) full settlement of all outstanding invoices, fees, charges, deposits, recovery costs, administrative fees, and applicable third-party charges;
(c) completion of identity, authority, security, and fraud-prevention checks required by Xdemór, the registrar, the registry, ICANN, or applicable law;
(d) registrar and registry transfer eligibility, including any applicable transfer lock, registrar lock, registry lock, 60-day transfer restriction, dispute hold, expiry status, redemption status, payment restriction, or verification requirement;
(e) the absence of unresolved disputes, abuse reports, legal holds, chargebacks, payment irregularities, ownership disputes, or compliance flags affecting the domain or related Services;
(f) the applicable Terms of Service, Individual Agreement, this Policy, and any registrar, registry, ICANN, dispute resolution, or legal requirements.
Xdemór does not guarantee that any transfer, account push, change of registrant, migration, release, export, or update will be accepted, completed, or processed by the registrar, registry, ICANN, or any third-party provider.
4.2 Client-Owned Domains #
Where the Client or a Client-designated party is the official registrant of the domain:
(a) the Client may request transfer, account push, nameserver change, DNS handover, or migration support after full settlement of all outstanding obligations and completion of applicable verification checks;
(b) Xdemór’s obligation is limited to reasonable operational assistance within the agreed scope, including release of registrar-level control, provision of basic transfer information, or coordination of EPP/AuthCode access where applicable and legally available;
(c) Xdemór may refuse, delay, or condition transfer assistance where the request is affected by non-payment, identity concerns, fraud risk, account compromise, registrar lock, registry lock, 60-day transfer restriction, expiry, redemption, chargeback, legal process, dispute, abuse investigation, or third-party enforcement action;
(d) Xdemór is not responsible for delays, failed transfers, failed account pushes, lost transfer windows, domain expiry, redemption fees, registry deletion, DNS downtime, email failure, or service disruption caused by registrar, registry, ICANN, third-party provider, Client action, or late transfer initiation;
(e) Xdemór is not required to provide proprietary DNS architecture, internal documentation, automation scripts, supplier account details, security rules, routing logic, performance configuration, monitoring systems, or optimisation methodology.
For avoidance of doubt, transfer or release of a Client-owned domain does not require Xdemór to replicate, teach, export, or reconstruct the managed service environment previously operated by Xdemór.
4.3 Xdemór-Administered Domains with Client Registrant Status #
Where a domain is administered through an account operated by Xdemór but the Client or a Client-designated party is the official registrant:
(a) Xdemór may coordinate registrar-level actions as the administrative account holder or operational contact;
(b) the Client remains responsible for providing correct authority, identity, contact, billing, and registrant information required for transfer or account changes;
(c) transfer or account release may be subject to registrar account procedures, registrar lock settings, registry rules, ICANN policies, transfer codes, internal security checks, payment clearance, and written confirmation;
(d) Xdemór may require a written handover request, authorised signatory approval, settlement confirmation, and confirmation of receiving registrar/account details before initiating any transfer-related action.
4.4 Xdemór-Registered or Xdemór-Held Domains #
Where Xdemór is the official registrant or controlling party for a domain, including domains acquired, reserved, or held for managed service delivery, staging, launch protection, migration, white-label deployment, brand protection, or infrastructure purposes:
(a) transfer to the Client is not automatic;
(b) no transfer right, account push right, change of registrant right, renewal right, redemption right, or continuing use right arises unless expressly agreed in writing;
(c) any transfer, sale, assignment, account push, or change of registrant is subject to written agreement, full payment, administrative review, risk review, registrar eligibility, registry rules, ICANN requirements, legal compliance, and Xdemór’s approval;
(d) Xdemór may refuse transfer where the Client has not fully paid, has breached the Terms, has triggered suspension or Final Lock, has engaged in abuse, has created legal/compliance risk, has failed verification, or where transfer is restricted by registrar, registry, ICANN, dispute, legal, fraud-prevention, or enforcement requirements;
(e) absent written agreement confirming transfer to the Client, Xdemór may disable, park, redirect, retain, renew, retire, repurpose, transfer, sell, or discontinue the domain following suspension, termination, expiry, service discontinuation, or Final Lock, subject to applicable registrar, registry, ICANN, legal, and contractual requirements.
4.5 Timing and Transfer Risk #
The Client acknowledges that domain transfers and account changes are time-sensitive and may fail or be delayed due to factors outside Xdemór’s control, including registrar processing times, transfer locks, expiry dates, redemption periods, DNS propagation, registry status, failed email approval, incorrect contact information, payment issues, communication failure, or third-party provider restrictions.
The Client is responsible for submitting transfer, migration, or handover requests sufficiently in advance of expiry, renewal deadlines, service termination, or provider migration deadlines.
Xdemór shall not be liable for failed or delayed transfers caused by late requests, incomplete information, unpaid balances, registrar restrictions, registry restrictions, ICANN rules, Client-side delay, third-party provider delay, or loss of access to Client-controlled systems.
4.6 Exports and Migration Scope #
Unless expressly agreed in writing, any export, handover, or migration assistance provided by Xdemór is limited to basic domain portability information and operational steps reasonably necessary to move a Client-owned domain or point it to another provider.
Exports and migration assistance do not include: #
(a) internal documentation;
(b) automation scripts;
(c) supplier account structure;
(d) proprietary DNS architecture;
(e) managed routing logic;
(f) proxy, CDN, security, firewall, caching, monitoring, or failover configuration;
(g) optimisation methodology;
(h) commercial know-how, diagnostic processes, or operational playbooks;
(i) equivalent managed performance, security, deliverability, routing, uptime, or functionality after migration.
4.7 Disclosure Requests, WHOIS, and Legal Process #
Requests concerning domain registration data, WHOIS-related records, privacy settings, registrant information, administrative contacts, technical contacts, billing contacts, disclosure, correction, suppression, legal notices, dispute notices, law enforcement requests, or authority requests shall be submitted to Xdemór as the contractual point of contact where the domain is administered through Xdemór.
Xdemór may receive, review for routing purposes, validate, transmit, or facilitate such requests to the applicable registrar, registry, privacy service provider, dispute resolution provider, legal authority, or competent third party.
Xdemór does not independently determine, approve, deny, override, or guarantee disclosure, suppression, correction, publication, transfer, suspension, cancellation, or release of domain registration data where such action is controlled by the registrar, registry, ICANN, legal process, law enforcement, court order, dispute procedure, or applicable law.
Disclosure, non-disclosure, correction, publication, transfer, suspension, or restriction of domain registration data may occur in accordance with registrar policies, registry rules, ICANN requirements, privacy service terms, applicable law, lawful requests, legal proceedings, or binding dispute resolution procedures.
4.8 Third-Party and Registrar Authority #
Nothing in this Section limits the independent authority of any registrar, registry operator, ICANN, dispute resolution provider, court, regulator, law enforcement authority, payment provider, hosting provider, DNS provider, email provider, CDN provider, or security provider to suspend, lock, cancel, redirect, transfer, reject, disclose, restrict, modify, or refuse any domain-related service.
Xdemór shall not be liable for any loss, delay, failure, interruption, suspension, cancellation, disclosure, failed transfer, failed renewal, failed update, expiry, redemption cost, registry deletion, or loss of use arising from such third-party authority, enforcement, policy, system, or operational action.
5. Suspension, Expiry, Renewal, and Termination #
5.1 Suspension of Managed Domain Services #
Upon suspension, restriction, termination, expiry, non-payment, service discontinuation, or Final Lock under the Terms of Service or applicable Policies, Xdemór may suspend, restrict, modify, park, redirect, disable, remove, or cease operating any managed service layer connected with a domain.
This may include, without limitation:
(a) DNS resolution or DNS zone management;
(b) nameserver operation;
(c) hosting, website availability, landing pages, microsites, or portals;
(d) redirects, tracking links, proxy layers, CDN routing, cache configuration, or failover settings;
(e) SSL/TLS certificates, validation records, and security configuration;
(f) email routing, MX records, SPF, DKIM, DMARC, forwarding, mailboxes, or transactional email configuration;
(g) subdomains, verification records, platform integrations, analytics, advertising verification, or third-party service connections;
(h) dashboards, support access, registrar coordination, and technical assistance.
Xdemór has no obligation to maintain domain functionality, DNS continuity, email continuity, website availability, SSL validity, redirects, tracking, or third-party integrations during any period of suspension, termination, non-payment, compliance review, abuse investigation, or Final Lock.
5.2 Effect on Registrant Status #
Suspension, termination, or Final Lock of the managed service layer does not, by itself, change the official registrant status of a Client-owned domain.
However, where the domain is administered, configured, routed, hosted, or supported through Xdemór’s infrastructure, suspension or termination may result in loss or interruption of functionality connected to that domain.
Where Xdemór is the official registrant or controlling party for a domain, Xdemór may retain, disable, park, redirect, renew, retire, repurpose, transfer, sell, discontinue, or allow the domain to expire following suspension, termination, non-payment, service discontinuation, or Final Lock, subject to applicable registrar, registry, ICANN, legal, and contractual requirements.
5.3 Expiry and Renewal Responsibility #
Unless expressly included in the applicable service plan, Individual Agreement, Order Form, or written service confirmation, Xdemór does not provide independent renewal monitoring, renewal guarantee, renewal insurance, domain portfolio supervision, or manual expiry management.
For Client-owned domains, the Client remains responsible for:
(a) tracking expiry dates;
(b) maintaining accurate registrant, billing, administrative, technical, and WHOIS-related information;
(c) ensuring sufficient funds and valid payment methods;
(d) responding to registrar, registry, ICANN, dispute, or verification notices;
(e) renewing the domain before expiry;
(f) paying any renewal, redemption, reinstatement, transfer, registry, registrar, administrative, or recovery fees.
Xdemór may, but is not obliged to, provide reminders, renewal assistance, administrative notices, or renewal coordination unless such service is expressly included in the applicable service scope.
5.4 Registrar Notices and ICANN Requirements #
The Client acknowledges that registrars may be required or permitted to send expiry, renewal, verification, transfer, WHOIS, dispute, or compliance notices directly to the registrant, account holder, administrative contact, technical contact, billing contact, or other email address associated with the domain.
Where such notices are sent by a registrar, registry, ICANN, privacy service provider, dispute body, or other authority, Xdemór does not guarantee receipt, forwarding, monitoring, interpretation, escalation, or response unless expressly agreed in writing.
The Client is responsible for monitoring all email addresses and contact points associated with the domain and for responding within any required deadline.
5.5 Expired Domains, Redemption, and Reinstatement #
If a domain expires, the applicable registrar or registry may, depending on the TLD and provider rules:
(a) disable DNS resolution;
(b) replace existing DNS or nameserver settings;
(c) park the domain;
(d) display advertising or commercial parking pages;
(e) change WHOIS or contact data presentation;
(f) make the domain available for reactivation, redemption, auction, deletion, sale, or third-party registration;
(g) charge renewal, redemption, reinstatement, recovery, administrative, or processing fees;
(h) refuse renewal, reinstatement, or recovery after applicable deadlines.
Xdemór does not control registrar or registry expiry, redemption, deletion, auction, parking, reactivation, or reinstatement procedures.
Xdemór shall not be liable for loss of domain rights, loss of use, downtime, email failure, loss of traffic, reputational harm, lost revenue, data loss, failed recovery, redemption fees, reinstatement fees, registry deletion, auction, third-party acquisition, or any other consequence arising from domain expiry, late renewal, failed payment, inaccurate contact details, missed notices, or delayed Client action.
5.6 Renewal of Xdemór-Held Domains #
Where Xdemór is the official registrant or controlling party for a domain, renewal remains at Xdemór’s discretion unless an active written agreement expressly requires renewal for the Client’s benefit.
Payment by the Client for hosting, support, infrastructure, setup, or managed services does not create an automatic right to renewal of any Xdemór-held domain unless domain renewal is expressly included in the applicable service scope.
Where a domain is service-linked, temporary, transitional, promotional, operational, white-label, or infrastructure-related, Xdemór may decide not to renew it following termination, suspension, non-payment, service discontinuation, breach, abuse risk, compliance issue, or Final Lock.
5.7 Reinstatement After Suspension or Expiry #
Reinstatement of any domain-related service after suspension, expiry, termination, or Final Lock is not guaranteed.
Any reinstatement may be subject to:
(a) full payment of all outstanding amounts;
(b) payment of renewal, redemption, reinstatement, recovery, administrative, legal, or third-party fees;
(c) identity and authority verification;
(d) registrar, registry, ICANN, legal, compliance, abuse, or fraud-prevention checks;
(e) technical feasibility;
(f) Xdemór’s operational approval;
(g) new commercial terms, deposits, upfront payment, revised pricing, or risk reclassification.
Partial payment does not create any right to partial reinstatement, temporary restoration, domain release, DNS reactivation, email recovery, hosting restoration, or support continuation.
5.8 No Liability for Third-Party Enforcement #
Xdemór shall not be liable for any suspension, expiry, deletion, lock, hold, failed renewal, failed reinstatement, failed transfer, disclosure, parking, redirect, cancellation, registry action, registrar action, ICANN action, payment provider action, legal action, dispute action, or third-party enforcement measure affecting any domain or related service.
The Client acknowledges that domain services remain subject to registrar, registry, ICANN, legal, payment, abuse, and compliance rules outside Xdemór’s direct control.
6. Anti-Circumvention, Abuse Prevention, and Domain Misuse #
6.1 Anti-Circumvention #
The Client shall not, directly or indirectly, use access to Xdemór’s domain-related Services to circumvent, bypass, reproduce, substitute, or materially reduce reliance on Xdemór’s managed service layer in breach of the Terms of Service.
Prohibited conduct includes, without limitation: #
(a) extracting, copying, reconstructing, reverse engineering, or deriving Xdemór’s non-public DNS architecture, routing logic, proxy setup, security rules, deployment standards, automation workflows, operational defaults, monitoring logic, diagnostic methods, or managed configuration methodology;
(b) using access credentials, DNS records, registrar access, nameserver information, support communications, configuration screenshots, audit results, or operational information obtained through Xdemór to recreate or imitate Xdemór’s managed service environment;
(c) inducing, instructing, or assisting any third party, provider, contractor, agency, reseller, end client, or competitor to replicate, interfere with, bypass, or reconstruct Xdemór-managed domain configurations or service delivery methods;
(d) attempting to replace Xdemór’s managed service layer by exploiting non-public configurations, integrations, technical decisions, supplier setup, or operational know-how obtained through the Services;
(e) using domain migration, transfer, export, access, audit, or support requests as a pretext to obtain proprietary configuration, internal documentation, automation logic, supplier account structure, security methodology, or operational playbooks.
Nothing in this Section prevents the Client from independently procuring domain registration, DNS, hosting, email, CDN, security, or infrastructure services in the open market, provided such procurement does not rely on, derive from, replicate, misuse, or exploit Xdemór’s non-public configurations, operational framework, automation, or proprietary service methodology.
6.2 Domain Abuse and Prohibited Conduct #
The Client shall not use, permit, enable, or facilitate the use of any domain, DNS configuration, subdomain, redirect, email routing, hosting environment, tracking link, landing page, microsite, portal, or related service connected with Xdemór for:
(a) illegal, fraudulent, deceptive, abusive, or misleading activity;
(b) phishing, malware, viruses, botnets, credential harvesting, spoofing, impersonation, or security attacks;
(c) spam, unsolicited bulk email, mail bombing, abusive forwarding, or practices damaging email deliverability or sender reputation;
(d) infringement of intellectual property, trademarks, copyright, trade secrets, privacy rights, publicity rights, or other third-party rights;
(e) impersonating another person, business, brand, platform, registrar, registry, authority, or service provider;
(f) redirecting to, masking, framing, or representing third-party websites, brands, platforms, or systems without permission;
(g) excessive DNS queries, abusive traffic, denial-of-service activity, packet flooding, scanning, probing, unauthorised access, or interference with networks, systems, registrars, registries, DNS providers, hosting providers, email providers, or other infrastructure;
(h) content or activity prohibited by the applicable registrar, registry, ICANN policies, hosting provider, email provider, DNS provider, CDN provider, payment provider, advertising platform, analytics platform, or applicable law;
(i) any activity likely to cause suspension, blacklisting, domain lock, registry hold, registrar enforcement, email filtering, SSL rejection, platform ban, legal claim, regulatory action, or reputational damage to Xdemór, its providers, other clients, or the relevant service environment.
6.3 Unauthorised Registrar, DNS, or Transfer Activity #
The Client shall not, without written authority: #
(a) attempt to unlock, transfer, push, modify, sell, assign, redirect, delete, renew, recover, or change registrant details for any domain administered or held by Xdemór;
(b) alter nameservers, DNSSEC, DNS records, MX records, SSL validation records, verification records, redirects, email routing, proxy settings, or security settings connected with Xdemór-managed services;
(c) request, extract, misuse, disclose, or share EPP/AuthCodes, registrar credentials, DNS access, account access, API keys, verification records, or technical access credentials;
(d) interfere with registrar, registry, ICANN, privacy service, DNS provider, hosting provider, email provider, CDN provider, or security provider procedures;
(e) make false, incomplete, misleading, or unauthorised representations about domain ownership, registrant status, authority, control, transfer eligibility, or service rights.
6.4 White-Label and End-Client Misrepresentation #
Where the Client acts as a reseller, agency, white-label operator, intermediary, or service provider to its own clients or end users, the Client shall not:
(a) represent itself as an ICANN-accredited registrar, registry operator, registrar-equivalent provider, or owner of Xdemór-controlled infrastructure unless legally authorised to do so;
(b) misrepresent domain ownership, registrant status, renewal responsibility, transfer rights, registrar identity, DNS control, service availability, or Xdemór’s role;
(c) promise end clients any domain transfer, renewal, uptime, recovery, disclosure, ownership, support, or service continuity rights that exceed the Client’s own rights under the Terms, this Policy, and the applicable registrar or registry rules;
(d) conceal required information from end clients where such concealment creates legal, billing, ownership, renewal, compliance, or operational risk.
The Client remains solely responsible for all claims, representations, omissions, disputes, complaints, losses, and liabilities arising from its relationship with end clients or sub-users.
6.5 Enforcement #
Any breach or suspected breach of this Section may constitute a material breach of the Terms of Service and may result in one or more of the following measures:
(a) immediate suspension or restriction of domain-related services;
(b) DNS modification, parking, disabling, redirect removal, nameserver change, or service isolation;
(c) suspension of hosting, email, redirects, portals, tracking, support, registrar coordination, or related infrastructure;
(d) refusal of transfer, export, migration, handover, or reinstatement assistance where legally and contractually permitted;
(e) escalation, High-Risk classification, revised payment terms, deposit requirement, or Final Lock;
(f) notification to registrars, registries, DNS providers, hosting providers, email providers, CDN providers, security providers, payment providers, regulators, law enforcement, or affected third parties where necessary;
(g) termination of the relevant Services.
Xdemór may take preventive or protective action where it reasonably considers that abuse, circumvention, fraud, legal risk, infrastructure risk, reputational harm, non-payment, unauthorised access, or third-party enforcement risk has occurred or is likely to occur.
6.6 No Limitation of Third-Party Enforcement #
Nothing in this Section limits the independent right of any registrar, registry operator, ICANN, dispute resolution provider, hosting provider, DNS provider, email provider, CDN provider, payment provider, regulator, court, law enforcement authority, or other competent authority to suspend, lock, cancel, redirect, transfer, disclose, restrict, refuse, or otherwise modify any domain or related service.
Xdemór shall not be liable for any loss, interruption, suspension, cancellation, transfer failure, renewal failure, disclosure, registry hold, registrar lock, blacklisting, filtering, platform restriction, or enforcement action arising from abuse, suspected abuse, third-party policy enforcement, legal process, or the Client’s conduct.
7. No Guarantees and Domain Service Limitations #
7.1 General No Guarantee #
Domain-related services are provided subject to the rules, systems, availability, policies, and enforcement powers of third parties, including registrars, registry operators, ICANN, ccTLD authorities, privacy service providers, DNS providers, hosting providers, email providers, CDN providers, certificate authorities, dispute resolution bodies, courts, regulators, law enforcement authorities, and other competent parties.
Xdemór does not guarantee that any domain-related request, configuration, registration, renewal, transfer, recovery, reinstatement, disclosure, suppression, privacy setting, DNS change, SSL validation, email routing, verification, or third-party integration will be accepted, completed, maintained, renewed, or remain available.
7.2 No Guarantee of Registration, Renewal, or Availability #
Xdemór provides no guarantee that:
(a) any specific domain name, TLD, subdomain, namespace, or registry product will be available;
(b) a domain registration request will be accepted by the registrar or registry;
(c) a renewal will be successful;
(d) an expired domain will be recoverable, restorable, redeemable, or reinstated;
(e) a domain will not be deleted, parked, auctioned, transferred, locked, suspended, redirected, or made available to third parties by a registrar or registry;
(f) a domain will remain available at the same price, renewal cost, redemption cost, transfer cost, or registry fee;
(g) registrar, registry, ICANN, ccTLD, legal, compliance, or policy requirements will remain unchanged.
7.3 No Guarantee of DNS, Email, SSL, or Service Continuity #
Xdemór provides no guarantee of uninterrupted or error-free:
(a) DNS resolution;
(b) nameserver operation;
(c) routing, redirects, proxying, caching, CDN operation, or failover;
(d) hosting, website availability, landing pages, portals, or microsites;
(e) SSL/TLS certificate issuance, renewal, validation, or browser trust;
(f) email routing, MX records, forwarding, SPF, DKIM, DMARC, mailboxes, deliverability, or transactional email operation;
(g) platform verification, advertising platform validation, analytics tracking, or third-party service integration.
Service interruptions may arise from DNS propagation, registrar action, registry action, certificate authority decisions, email filtering, blacklist events, provider outages, client-side misconfiguration, third-party platform changes, abuse investigations, legal process, or security controls.
7.4 No Guarantee of Transfer, Migration, or Export Outcome #
Xdemór does not guarantee that any domain transfer, account push, change of registrant, registrar release, EPP/AuthCode request, migration, DNS handover, export, or receiving-provider setup will be successful.
Transfers and migrations may fail or be delayed due to registrar locks, registry locks, 60-day transfer restrictions, expiry, redemption status, incorrect registrant data, failed email approval, identity verification, payment issues, disputes, abuse reports, legal process, third-party provider restrictions, or Client delay.
7.5 No Guarantee of WHOIS, Privacy, or Data Disclosure Outcome #
Xdemór does not guarantee that WHOIS privacy, proxy protection, redaction, suppression, disclosure, correction, publication, or non-publication of domain registration data will be available or maintained.
Domain registration data may be disclosed, restricted, corrected, published, withheld, or processed in accordance with registrar rules, registry policies, ICANN requirements, privacy service terms, lawful requests, dispute procedures, court orders, law enforcement requests, or applicable law.
7.6 Third-Party Enforcement and Policy Changes #
Xdemór shall not be liable for any loss, interruption, suspension, cancellation, lock, hold, redirect, failed renewal, failed transfer, failed recovery, failed validation, failed verification, disclosure, non-disclosure, deletion, auction, price change, service restriction, platform rejection, blacklist event, or loss of use caused by:
(a) registrar, registry, ICANN, ccTLD, or dispute resolution action;
(b) hosting, DNS, email, CDN, SSL, security, analytics, advertising, or platform provider action;
(c) payment provider action, chargeback, failed billing, fraud-prevention review, or compliance flag;
(d) legal process, regulator request, law enforcement request, court order, or third-party claim;
(e) Client conduct, inaccurate information, non-payment, late renewal, missed notice, misconfiguration, unauthorised change, or failure to respond.
7.7 No Warranty Beyond Express Service Scope #
Any support, renewal assistance, transfer assistance, DNS configuration, migration support, troubleshooting, monitoring, or recovery action provided by Xdemór is limited to the applicable service scope.
No statement, support message, configuration attempt, renewal attempt, transfer attempt, or technical assistance shall be interpreted as a guarantee of outcome, uninterrupted service, successful recovery, successful transfer, continued availability, equivalent configuration, or future compatibility.
8. Relationship to Other Policies and Third-Party Rules #
8.1 Relationship to Xdemór Policies #
This Policy operates alongside, and forms part of, Xdemór’s wider contractual and policy framework, including where applicable:
(a) Terms of Service;
(b) Acceptable Use Policy;
(c) Hosting & Infrastructure Policy;
(d) Service Status & Notifications Policy;
(e) High-Risk Client Addendum;
(f) Privacy Policy;
(g) Data Processing Agreement;
(h) Website & Web Development Policy, where domain configuration is connected to website delivery, hosting, launch, migration, or technical support;
(i) any applicable Individual Agreement, Proposal, Order Form, Statement of Work, Annex, or written service confirmation.
This Policy governs domain-specific matters, including domain registration models, registrant status, registrar administration, DNS control, transfer coordination, renewal responsibility, expiry handling, domain-related suspension, and domain-related disclosure routing.
Other Xdemór policies continue to govern their respective subject matter, including payment, suspension, Final Lock, infrastructure access, hosting, email, support, data processing, service notifications, website delivery, security, acceptable use, and high-risk client behaviour.
8.2 Relationship to Registrar, Registry, ICANN, and Legal Rules #
All domain-related services remain subject to the applicable registrar agreement, registry rules, ICANN policies, ccTLD authority rules, dispute resolution procedures, privacy service terms, certificate authority rules, hosting provider rules, email provider rules, DNS provider rules, CDN provider rules, and applicable law.
Nothing in this Policy limits, overrides, replaces, or modifies the independent rights, obligations, restrictions, procedures, or enforcement powers of any registrar, registry operator, ICANN, ccTLD authority, dispute resolution provider, court, regulator, law enforcement authority, or competent third party.
Where registrar, registry, ICANN, ccTLD, legal, dispute, or enforcement rules require or prohibit a particular action, such rules shall prevail over any inconsistent operational arrangement or service expectation.
8.3 Conflict Between Policies #
In the event of conflict or inconsistency, the following order shall apply, to the extent legally permitted:
(a) mandatory applicable law, court orders, regulator requirements, law enforcement obligations, and binding dispute resolution decisions;
(b) registrar, registry, ICANN, ccTLD, certificate authority, and other mandatory third-party rules applicable to the relevant domain or service;
(c) any signed Individual Agreement, Proposal, Order Form, Statement of Work, or Annex, but only where it does not conflict with mandatory law or third-party rules;
(d) Xdemór’s Terms of Service;
(e) this Domain Names Policy for domain-specific matters;
(f) other Xdemór policies for their respective subject matter.
8.4 No Expansion of Client Rights
References to other policies, third-party terms, registrar rules, registry rules, ICANN policies, or provider procedures do not grant the Client any ownership, registrant status, transfer right, renewal right, access right, support right, service-level guarantee, or third-party enforcement right beyond what is expressly provided in the applicable agreement and confirmed by the relevant registrar, registry, or authority.
8.5 Policy Portal #
The applicable Xdemór policies are made available through Xdemór’s designated policy portal and may be updated in accordance with the Terms of Service and the policy incorporation provisions stated there.
9. Governing Law and Jurisdiction #
This Policy is governed by the laws of England and Wales.
The courts of England and Wales have exclusive jurisdiction.
