1. Legal Status and Application #
This Hosting & Infrastructure Policy (“Policy”) governs hosting, infrastructure, and related technical services provided by The Xdemór Group Limited (“Xdemór”), including services offered under its brands such as Fludnox and Xdorable.
This Policy applies to all clients, partners, and licensees using Xdemór hosting or infrastructure services, unless otherwise agreed in writing.
This Policy forms part of the contractual framework governing the Services together with the Xdemór Terms of Service.
2. Nature of the Services #
Hosting and infrastructure services are provided as managed services intended to support the availability and operation of websites, applications, and related digital services.
Services are delivered through hosted environments operated or managed by Xdemór.
No ownership or transfer of infrastructure, systems, or software is granted to the Client unless expressly agreed in writing.
3. Scope of Services #
Hosting & Infrastructure Services may include:

web and application hosting;

managed hosting environments;
-
content delivery and caching services;
-
basic monitoring and security controls;
-
access to hosting panels or dashboards provided by Xdemór.
The specific scope of services depends on the applicable service plan or agreement.
Services not expressly included are outside the scope of this Policy.
4. Infrastructure and Implementation #
The Services may be delivered using a combination of licensed software, third-party platforms, and Xdemór-managed configurations.
Xdemór may update, modify, or reconfigure infrastructure components as required for operational, security, or performance reasons.
5. Intellectual Property #
5.1 Client Data #
The Client retains ownership of its own data and content submitted to the Services, subject to any licences granted to Xdemór for service delivery.
5.2 Xdemór Services #
Except for Client Data, no intellectual property rights are transferred to the Client.
Xdemór retains rights in the operation and delivery of the Services.
6. Acceptable Use #
The Client must use the Services in compliance with:

applicable laws and regulations;

the Xdemór Terms of Service;

any applicable Acceptable Use Policies.
Xdemór may suspend or restrict Services where necessary to address misuse, security risks, or legal compliance requirements.
7. Availability and Performance #
Services are provided on an “as is” and “as available” basis.
Xdemór does not guarantee uninterrupted availability, performance levels, or error-free operation unless expressly agreed in writing.
8. Data Protection #
Where personal data is processed in connection with the Services:

the Client acts as Data Controller;

Xdemór acts as Data Processor.
Data processing is governed by the applicable Data Processing Agreement.
9. Termination and Exit #
Upon termination of the Services, the Client may request export of its data in accordance with the Terms of Service and applicable agreements.
Xdemór is not required to provide internal configurations, tooling, or operational documentation.
10. Limitation of Liability #
To the maximum extent permitted by law, Xdemór is not liable for indirect or consequential losses, third-party service failures, or data loss outside agreed backup services.
Liability is limited in accordance with the Terms of Service.
11. Domains #
Domain name registration and management are governed by separate domain-specific terms and are not covered by this Policy.
12. Governing Law #
This Policy is governed by the laws of England and Wales.
The courts of England and Wales have exclusive jurisdiction.
